1. Purpose
These Terms of Use (hereinafter the “Terms”) govern access to and use of the drive-andorra.com website (hereinafter the “Site”), published by RÉMI BRANDINI EURL (hereinafter the “Publisher”). Any use of the Site implies full and unreserved acceptance of these Terms.
The Publisher reserves the right to amend these Terms at any time. The applicable version is the one online at the time of consultation.
2. Nature of the service
Drive-Andorra is an independent broker that puts users (private individuals and businesses) in contact with partner providers specialising in vehicle registration in Andorra.
The Publisher is neither an agent, nor an insurance intermediary, nor an administrative registration provider. No contract for a registration service is entered into with the Publisher through the Site: any contract relating to the service is concluded directly between the user and the provider they have selected.
3. Business model and independence
The Publisher carries out brokerage and qualified lead generation on behalf of its partner providers (Andorran gestories, registration brokers, official dealerships of the Principality). The Publisher is paid by the providers, either through a success fee (business introduction when a referral results in a sale) or through a fixed fee per lead transmitted, depending on the commercial agreements concluded with each partner. The providers receiving the data then contact the user directly to present their commercial offers. This commission is built into the provider margin and has no impact on the price paid by the user.
The Publisher declares that the rankings and recommendations published on the Site are established on the basis of objective criteria (price, lead times, services included, regulatory compliance, user feedback) and independently of the level of commission received. In accordance with Article L.111-7 of the French Consumer Code, the Publisher undertakes to provide fair, clear and transparent information on the criteria used to rank and list providers.
4. Access to the Site
The Site is accessible 24 hours a day, 7 days a week, subject to technical interruptions relating to maintenance, network incidents or events of force majeure. The Publisher does not guarantee the permanent availability of the service.
Use of the Site requires compatible equipment (a recent browser, an Internet connection). Costs associated with accessing the Site are borne by the user.
5. Use of the forms
The user undertakes to provide accurate, complete and up-to-date information when completing the forms on the Site. Any false declaration or identity theft is punishable under Articles 226-4-1 and 313-1 of the French Criminal Code.
Data is transmitted to partner providers in accordance with the Privacy Policy, after the user has expressly validated the list of selected providers.
6. Intellectual property
All elements of the Site (texts, trade marks, logos, photographs, layouts, code, simulators, databases) are protected by French and international intellectual property law. They are the exclusive property of RÉMI BRANDINI EURL or are used with the authorisation of their rights holders.
Any reproduction, representation, modification, publication, transmission or exploitation, in whole or in part, by any means whatsoever, without the prior written authorisation of the Publisher, is strictly prohibited and constitutes an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.
7. Liability
The Publisher provides the information published on the Site for guidance only and endeavours to ensure that it is accurate and up to date. Nevertheless, the Publisher cannot be held liable for:
- changes in Andorran or French regulations on registration, taxation or customs;
- the acts, services, delays, failures to perform or disputes attributable to the partner providers selected by the user;
- indirect damage (loss of operating income, loss of opportunity, commercial harm) resulting from use of the Site;
- technical malfunctions, unavailability, viruses or intrusions relating to the Internet network or to events of force majeure;
- decisions taken by the user on the basis of the Site content without prior validation by a qualified professional.
The simulation and comparison tools offered on the Site (in particular the savings calculator) provide indicative estimates based on the scales in force. These estimates cannot replace a personalised quotation from a registration provider or the advice of a legal or tax professional.
8. Moderation and notice (Article 14 DSA)
In accordance with Article 14 of Regulation (EU) 2022/2065 on digital services (Digital Services Act), any content published by a user on the Site (review, comment) may be moderated by the Publisher before or after publication. The following content is prohibited in particular:
- content that is unlawful under French or European law;
- defamatory, insulting, racist or discriminatory content, content of a pornographic nature or content that undermines human dignity;
- content that infringes the privacy, image rights or intellectual property rights of third parties;
- unauthorised advertising or promotional content.
To report content that is unlawful or contrary to these Terms, the user may send a notice to contact@drive-andorra.com stating the address concerned and the reason. The Publisher processes notices within 7 working days and acknowledges receipt by return email.
9. Hyperlinks
The Site may contain hyperlinks to third-party sites (partner providers, regulatory sources, sector resources). These links are provided for information purposes. The Publisher exercises no control over the content of these third-party sites and accepts no liability for their content, their availability or their data protection practices.
Creating a hyperlink to the Site is permitted provided that it does not harm the Publisher image, is not carried out in a fraudulent or misleading context, and respects the Drive-Andorra trade mark. The Publisher reserves the right to request the removal of any non-compliant link.
10. Personal data
The processing of personal data collected through the Site is governed by our Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. In particular, the user has rights of access, rectification, erasure, restriction, portability and objection in respect of their personal data.
11. Amendments to the Terms
The Publisher reserves the right to amend these Terms at any time in order to take account of legislative, regulatory, case-law or technical developments. The applicable version is the one online at the time the Site is consulted.
Substantial amendments will be the subject of a notice displayed on the Site for 30 days from the date they take effect. Continued use of the Site after publication of the amended Terms constitutes acceptance of the new version.
12. Applicable law, mediation and jurisdiction
These Terms are governed by French law.
In the event of a disagreement arising from the interpretation or performance of these Terms, the parties will endeavour to resolve the dispute amicably. Consumer users may refer the matter free of charge to the consumer ombudsman under the conditions set out in the “Consumer mediation” section of the Legal Notice.
Failing an amicable settlement, any dispute falls within the jurisdiction of the French courts, in accordance with the rules applicable to consumers (Article R.631-3 of the French Consumer Code) or with ordinary law rules for business users.
